These Terms of Service ("Terms") govern your use of the Within mobile application ("the App") operated by Common Practice ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 13 years old to use Within. By using the App, you represent that you meet this age requirement. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Within is a personal journaling and self-reflection tool. It uses artificial intelligence to help you identify emotional patterns and reflect on your experiences.
Within is not a substitute for professional mental health care. The App does not provide medical advice, therapy, counseling, diagnosis, or treatment. The AI-generated insights, emotional analysis, and reflective prompts are informational tools — they are not clinical assessments and should not be treated as such.

You sign in to Within using Apple Sign-In or Google Sign-In. You are responsible for maintaining access to your sign-in account and for all activity that occurs under it. Your encryption keys are synced across your Apple devices via iCloud Keychain, which is end-to-end encrypted by Apple. As long as you maintain access to your Apple ID and iCloud Keychain, your journal entries will be available on any device you sign in to. We do not have access to your encryption keys and cannot decrypt your data on your behalf.
You own your content. All journal entries, reflections, notes, and other content you create in Within belong to you. We do not claim any ownership or intellectual property rights over your content.
License to operate. By using the App, you grant us a limited license to process your content solely to provide the App's functionality — including encrypting and storing your entries, transmitting redacted text to AI services for analysis, and syncing across your devices. This license exists only to make the App work and terminates when you delete your account.
Your responsibility. You are solely responsible for the content you create in Within. Do not use the App to store content that is illegal or that violates the rights of others.
The App uses artificial intelligence (provided by OpenAI and Anthropic) to generate emotional insights, behavioral analysis, themes, and reflective prompts based on your journal entries.
AI outputs are not guaranteed to be accurate, complete, or appropriate. AI systems can misinterpret context, produce incorrect analysis, or generate responses that do not reflect your actual emotional state. You should treat AI-generated content as one perspective — not as fact or professional guidance.
We are not liable for any decisions you make or actions you take based on AI-generated content in the App.

We reserve the right to suspend or terminate your account if you violate these Terms.
If the App offers paid features or subscriptions, they are processed through Apple's App Store. All billing, renewals, and cancellations are governed by Apple's terms. To cancel a subscription, use your device's Settings > Apple ID > Subscriptions. We do not process payments directly and do not have access to your payment information.
Refund requests for App Store purchases must be directed to Apple.
We strive to keep Within available and functioning, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We may update, modify, or discontinue features of the App at any time. If we make changes that materially reduce the App's core functionality, we will make reasonable efforts to notify you in advance.
To the fullest extent permitted by applicable law:
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify and hold harmless A.Warding and its affiliates, officers, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

Before initiating any formal proceeding, you agree to contact us at contact@seewhatswithin.com and attempt to resolve the dispute informally for at least 30 days.
If we cannot resolve the dispute informally, you and we agree to resolve any dispute, claim, or controversy arising from or relating to these Terms or the App through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.
You and we agree that any dispute resolution will be conducted on an individual basis only, and not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.
The following are not subject to arbitration:
You may opt out of this arbitration agreement by sending written notice to contact@seewhatswithin.com within 30 days of first agreeing to these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration. If you opt out, you retain your right to file a lawsuit.
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any legal action not subject to arbitration shall be brought in the state or federal courts located in California.
You may stop using the App at any time. You may request account deletion by contacting us at contact@seewhatswithin.com.
We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately. Sections 4 (Your Content — ownership), 5 (AI-Generated Content), 9 (Limitation of Liability), 10 (Indemnification), 11 (Dispute Resolution), and 12 (Governing Law) survive termination.
We may revise these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree, stop using the App and request account deletion.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App, and supersede any prior agreements.
